Terms and conditions

specifying, inter alia, principles governing concluding sales contracts within the framework of the Store, as well as incorporating most important pieces of information on the Seller, the Store and the rights of the Consumer

 

The provisions regarding the Privileged Entrepreneur apply to contracts concluded from January 1st 2021 onwards.

  • 1 DEFINITIONS

Working days - days from Monday to Friday, except public holidays.

Consumer - consumer as specified by the provisions of the Civil Code.

Account - free Store function regulated by separate regulations (digitally rendered service), thanks to which the Buyer can set up an individual account in the Store.

Buyer - any entity making purchases in the Store. 

Privileged Buyer - privileged consumer or entrepreneur. 

Privileged Entrepreneur -  natural person concluding an agreement with the Seller directly related to his or her business activity, but not having a professional character for him or her (the definition applies to contracts concluded from January 1st  2021 onwards).

  • 2 CONTACT WITH THE SELLER

  • 3 TECHNICAL REQUIREMENTS
  1.  For the proper functioning of the Store, the following are necessary:
  •  device with Internet access
  •  web browser supporting JavaScript and Cookies.
To place an order in the Store, in addition to the requirements specified in paragraph 1, an active e-mail account is required.
  • 4 PURCHASES IN THE STORE
  1. Prices of items displayed in the Store are total prices of said items.
  2. Seller informs that the total price of the order consists of the following indicated while using the Store: the price of the items and, if applicable, the cost of delivery.
  3. Product selected for purchase should be added to the cart in the Store.
  4. Afterwards, the Buyer shall select the following: the method of items delivery and the method of payment for the order. The Buyer shall also provide data necessary to complete the order.
  5. Order is placed upon confirmation of its content and acceptance of those Terms and Conditions by the Buyer.
  6. Placing an order is equivalent to concluding a sales contract between the Buyer and the Seller.
  7. Seller shall provide the Privileged Buyer with the confirmation of the conclusion of the sales contract on a tangible medium no later than upon the delivery of the items ordered.
  8. Buyer may register in the Store, i.e. register an Account within its scope, as well as make purchases without registration by providing his or her data while placing each and every order.
  • 5 PAYMENTS
  1. The placed order can be paid for, depending on the Buyer's preferences:
    1. by traditional transfer to the Seller's bank account;
    2. with a credit card:
  • Visa
  • Visa Electron
  • MasterCard
  • MasterCard Electronic
  • Maestro
 via the payment platform:
  •  Shoper Payments
While choosing to pay via the Shoper Payments platform, Blue Media Inc. shall be the entity providing online payment services If the Buyer selects payment in advance, the order shall be paid for within 5 business days from the moment of order placement.   Seller informs that in the case of some payment methods and due to their specificity, payment for the order may be possible only immediately after placing the order. By making purchases in the Store, the Buyer accepts the utilization of digital invoices by the Seller. The Buyer has the right to withdraw his or her acceptance at any time.
  • 6 ORDER REALIZATION
  1. Seller is obliged to deliver the items without defects.
  2. Order completion date shall be specified in the Store.
  3. If the Buyer has chosen to pay in advance for the order, the Seller shall proceed with the order realization after receiving payment for it.
  4. If the Buyer has purchased items with different delivery dates under one order, the order shall be realized within the timeframe applicable to the items with the longest delivery date.
  5. Items shall be delivered only within the borders of the Republic of Poland.
  6. Items purchased in the Store are delivered depending on the delivery method selected by the Buyer:
    1. via a courier company
  7. Buyer may collect the goods in person at the company's premises during its working hours.
  8. If the Buyer selects the personal collection method, the items will be ready for collection at the indicated date and if the Seller has indicated the date of item - within said period.
  • 7 RIGHT TO WITHDRAW FROM THE CONTRACT
  1. Privileged Buyer has the right to withdraw from the contract concluded with the Seller via the Store, subject to § 8 of those Terms and Conditions, within 14 days without providing any reason for such a decision whatsoever.
  2. Deadline to withdraw from the contract expires after 14 days from the day:
    1. on which the Privileged Buyer came into possession of the items or in which a third party other than the carrier and indicated by the Privileged Buyer came into possession of the items;
    2.  on which the Privileged Buyer came into possession of the last item or on which a third party, other than the carrier and indicated by the Privileged Buyer, acquired the last item - in the case of a contract based on transferring the ownership of many items that are delivered separately.
  3. In order for the Privileged Buyer to be able to exercise the right to withdraw from the contract, he or she must inform the Seller, opting for data provided in § 2 of those Terms and Conditions, about the decision to withdraw from the contract by issuing an unequivocal statement (e.g. a letter sent by post or notification sent via e-mail).
  4. Privileged Buyer may use the template of the withdrawal form included at the end of those Terms and Conditions. Nevertheless, it is not obligatory.
  5. In order to meet the deadline to withdraw from the contract, it is sufficient for the Privileged Buyer to send the notification on the willingness to exercise his or her right to withdraw from the contract before the deadline to withdraw from the contract.

    OUTCOMES OF CONTRACT WITHDRAWAL
  6. In the event of withdrawal from the concluded contract, the Seller shall return to the Privileged Buyer all the payments received, including the costs of delivering the goods (except for additional costs resulting from the preferred method of delivery chosen by the Buyer other than the cheapest standard delivery method offered by the Seller) no later than within 14 days from the date on which the Seller was informed about the Privileged Buyer's decision to exercise the right to withdraw from the contract.
  7. Payments shall be returned by the Seller by using the same payment methods that were used by the Preferred Buyer during the original transaction, unless the Privileged Buyer agrees to a different solution. In any case, the Privileged Buyer shall not incur any fees in connection with said return.
  8. Seller may withhold the return until the collection of the items or until a proof of their return is provided, whichever occurs first.
  9. Seller requests to return the items to the following address: Przy Forcie 10/140 Street, 02-495 Warsaw (Poland) no later than within 14 days from the date on which the Privileged Buyer informed the Seller about the withdrawal from the sales contract. The deadline is considered met if the Privileged Buyer sends back the goods before the expiry of the 14-day period.
  10. Privileged Buyer shall bear the direct costs of returning the items.
  11. Privileged Buyer shall be responsible only for the decrease in the value of the items resulting from using them in a different way than necessary to establish the nature, characteristics, and functions of the items. 
  12. If the items, due to their nature, cannot be returned by regular mail, the Privileged Buyer will also have to bear the direct costs of returning such items. The Privileged Buyer will be informed about the estimated amount by the Seller in the description of the items in the Store or when placing the order.
  13. If there is a need to return funds for a transaction made by the Privileged Buyer via a credit card, the Seller will return the funds to the bank account assigned to said card. 

 

  • 8 EXCEPTIONS TO THE RIGHT TO WITHDRAW FROM THE CONTRACT
  1. Right to withdraw from the contract discussed in § 7 of those Terms and Conditions does not apply to the contract:
    1. in the case which the subject of the contract is a non-prefabricated item, manufactured according to the specification provided by the Privileged Buyer or serving to satisfy his or her individual needs;
    2. in the case of which the subject of the contract is an item that deteriorates quickly or has a short shelf-life;
    3. in the case of which the subject of the contract is an item delivered in a sealed package, which - after opening the package - cannot be returned due to health protection or hygiene-related reasons, especially if the packaging has been opened after delivery;
    4. in the case of which the subject of the contract are items that will be inseparably connected with other items after delivery due to their nature;
    5.  in the case of which the subject of the contract are sound or visual recordings or pieces of computer software delivered in a sealed package, especially if the package has been opened after delivery;
    6. for the delivery of newspapers, periodicals, or magazines, with the exception of subscription contracts;
    7. in the case of which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the deadline to withdraw from the contract.

 

  • 9 COMPLAINTS

 

  1. In the goods are faulty, the Consumer can file a complaint basing on warranty or provided for in the Civil Code, provided that such warranty has been granted.
  2. While taking advantage of the warranty-related rights, the Consumer may, on the terms and within the time limits specified in the Civil Code:
    1. submit a price reduction request,
    2. in the case of a significant defect - submit a statement of withdrawal from the contract,
    3. demand the faulty item to be replaced with the one that is free from defects,
    4. demand the defect to be removed.
  3. Seller informs about the necessity of submitting a complaint based on the warranty to the postal or digital address indicated in § 2 of those Terms and Conditions.
  4. If it turns out that in order to consider the complaint, it is necessary to deliver the defective goods to the Seller, the Consumer is obliged to deliver the goods at the Seller's expense, to the following address: Przy Forcie 10/140 Street, 02-495 Warsaw, Poland.
  5.  If the product has an additional warranty, information about it, as well as about its conditions, is available in the product description in the Store.
  6. Complaints regarding the functioning of the Store should be sent to the e-mail address indicated in § 2 of those Terms and Conditions.
  7. The complaint shall be handled by the Seller within 14 days.

    EXTRAJUDICIAL METHODS OF SETTLING COMPLAINTS AND PURSUING CLAIMS
  8. If the complaint procedure does not bring the result expected by the Consumer, the Consumer may opt for, among others:
    1. mediation supervised by the competent Provincial Inspectorate of Trade Inspection, to which the Consumer should apply for mediation. The procedure is free of charge. The list of Inspectorates is available at: https://www.uokik.gov.pl/wazne_adresy.php#faq595 ; 
    2. assistance of the competent amicable consumer court cooperating with the Provincial Inspectorate of Trade Inspection, to which an application should be submitted. The procedure is free of charge. The list of courts is available at: https://www.uokik.gov.pl/wazne_adresy.php#faq596 ; 
    3. free help from the municipal or provincial Consumer Ombudsman;

  • 10 PERSONAL DATA

 

  1. The Seller shall be the administrator of personal data provided by the Buyer while using the Store. Detailed information on the processing of personal data by the Seller - including its purposes, grounds, as well as data recipients - can be found in the Privacy Policy document available within the framework of the Store - it is caused by the principle of transparency incorporated in the general regulation of the European Parliament and of the Council (EU ) on data protection - "GDPR".
  2. Purpose of processing the Buyer's data by the Seller in connection with purchases made in the Store, is the realization of orders. The basis for processing personal data in this case is as follows:
  • contract or actions taken at the request of the Buyer aiming at concluding it (Article 6 section 1 paragraph b of the GDPR),
  • the legal obligation of the Seller related to accounting (Article 6 section 1 paragraph c and
  •  legitimate interest of the Seller, based on data processing in order to establish, assert, or defend claims (Article 6 section 1 paragraph f of the GDPR).
Providing data by the Buyer is voluntary, but necessary to conclude the contract. The failure to provide data makes the conclusion of a contract within the framework of the Store impossible. Buyer's data provided in connection with purchases in the Store will be processed until:
  1. contract concluded between the Buyer and the Seller ceases to apply;
  2. Seller is no longer be bound by legal obligations to process the Buyer's data;
  3. possibility of pursuing claims by the Buyer or the Seller related to the contract concluded by the Store ceases;
  4. Buyer's objection to personal data processing is accepted - if the basis for data processing is the legitimate interest of the Seller

depending on what is applicable in a given case and what will happen at the latest.

  1. Buyer has the right to demand:
    1. access to his or her personal data,
    2. right to amend such data,
    3. right to delete such data,
    4. right to impose processing restrictions,
    5. right to transfer data to another administrator
      as well as the right to:
    6. object at any time to the processing of data for reasons related to the specific situation of the Buyer - objection to processing personal data concerning the Buyer basing on article 6 section 1 paragraph f of the GDPR (legitimate interests of the administrator).
  2. In order to exercise his or her rights, the Buyer should contact the Seller by taking advantage of data provided in § 2 of those Terms and Conditions.
  3. If the Buyer considers that his or her data is being processed unlawfully, the Buyer may submit a complaint to the Chairman of the Office for Personal Data Protection.

 

  • 11 RESERVATIONS
  1.  It shall be forbidden for the Buyer to provide illegal content.
  2. Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of those Terms and Conditions. The contract shall be concluded for the duration and for the purpose of order fulfillment.
  3. Contracts concluded basing on those Terms and Conditions shall be concluded in Polish.
  4. In the event of a dispute with a Buyer who is not a Privileged Buyer, the court having jurisdiction over the seat of the Seller shall be appointed to settle it.
  5. Any liability of the Seller towards the Buyer who is not a Privileged Buyer shall be excluded within the limits permitted by law.
  6. Liability under the warranty towards a Privileged Entrepreneur shall be excluded.

  • 3 TECHNICAL REQUIREMENTS
  1.  For the proper functioning and creation of an Account, the User needs:
  • active e-mail account
  • device with Internet access
  • web browser supporting JavaScript and Cookies

 

  • 4 ACCOUNT
  1. Creating an Account is voluntary and depends on the will of the Buyer.
  2. Account gives the Buyer additional options, such as: viewing the history of orders placed in the Store, checking status of orders, and editing the Buyer's data.
  3. In order to create an Account, the Buyer must fill in the appropriate form in the Store.
  4. At the moment of the Account creation, a contract is concluded for an indefinite period of time between the Buyer and the Seller the subject of which is the maintenance of the Account on terms specified in those Terms and Conditions.
  5. Buyer may delete the Account at any time without incurring any costs.
  6. In order to delete the Account, please send a notification to the Seller at the following e-mail address: biuro@desayer.pl, which will result in the immediate deletion of the Account and termination of the Account maintenance contract.

 

  • 5 COMPLAINTS

 

  1. Complaints regarding the functioning of the Account shall be sent to the following e-mail address: biuro@desayer.pl.
  2. Complaints will be handled by the Seller within 14 days.

  • 6 PERSONAL DATA

 

  1. Seller shall be the administrator of personal data provided by the Buyer while using the Account.   2. Purpose of Buyer's data processing the maintaining his or her an Account. The basis for personal data processing in this case is a contract for the provision of a service or actions taken at the request of the Buyer aimed at its conclusion (Article 6 section 1 paragraph b of the GDPR), as well as the Seller's legitimate interest based on processing data in order to establish, pursue, or defend against any claims (Article 6 section 1 paragraph f of the GDPR).
  3. Providing data by the Buyer is voluntary, yet necessary for managing the Account. The failure to provide said data shall result in the Seller not being able to provide the Account management service.
  4. Buyer's data shall be processed until:
    1. account is deleted by the Buyer or by the Seller at the Buyer's request
    2. possibility of pursuing claims by the Buyer or the Seller related to the Account ceases;
    3. Buyer's objection to personal data processing is accepted - if the basis for data processing has been the legitimate interest of the Seller

- depending on what is applicable in a given case and what will happen last.

  1. Buyer has the right to demand:
    1. access to his or her personal data,
    2. such data amendment,
    3.  such data deletion,
    4. request processing restrictions,
    5.  transferring data to another administrator
      as well as has the right to:
    6. object at any time to the processing of data for reasons related to the specific situation of the Buyer - object to the processing of personal data concerning him or her, basing on article 6 section 1 paragraph f of the GDPR (legitimate interests pursued by the administrator).
  2. In order to exercise his or her rights, the Buyer shall contact the Seller.
  3. If the Buyer is of the opinion that his or her data is being processed unlawfully, the Buyer may submit a complaint to the Chairman of the Office for Personal Data Protection.

 

  • 7 RESERVATIONS

 

  1. It shall be forbidden for the Buyer to provide illegal content.
  2. Account management contract shall be concluded in Polish.
  1. Shall important reasons referred to in paragraph 4 occur, the Seller shall have the right to amend those Terms and Conditions .
  2. Important reasons, referred to in paragraph 3 are:
    1. adapting the Store to the legal provisions applicable to the Store's operations
    2. improving the security of the service provided
    3. changing the functionality of the Account that requires modification of the Terms and Conditions.
  3. Buyer shall be informed about the planned amendment to those Terms and Conditions at least 7 days before the change is implemented via an e-mail sent to the address connected with the Account.
  4. If the Buyer does not accept the planned change, he or she should inform the Seller about said fact by sending an appropriate message to the Seller's e-mail address, namely: biuro@desayer.pl, which will result in the termination of the Account maintenance contract upon the introduction of the planned change or earlier, if the Buyer makes such a request.
  5. If the Buyer does not object to the planned change up to the moment of its entry into force, it is assumed that he or she accepts it, which does not restrict the possibility of terminating the contract in the future.
  6. In the event of a dispute with a Buyer who is not a Privileged Buyer, the court handling the case shall be the court having jurisdiction over the seat of the Seller.

  • 1 DEFINITIONS

Newsletter - free service provided electronically, thanks to which the Service Recipient may receive from the Service Provider ordered messages regarding the Store digitally, including information about offers, promotions, and new products in the Store. 

Privileged Entrepreneur  -  natural person concluding a contract with the Service Provider directly related to its business activity, but not having a professional character for him or her (the definition applies to contracts concluded from January 1st 2021 onwards).

Recipient - any entity using the newsletter service. 

Privileged User - a Privileged Consumer or Entrepreneur.

  • 2 Newsletter
  1. Service Recipient may use the Newsletter service voluntarily.
  2. To take advantage of the Newsletter service, a device with the latest version of web browser that supports JavaScript and cookies installed, as well as with access to the Internet and an active e-mail account are required.
  3. E-mail messages sent within the framework of the service will be sent to the e-mail address provided by the Customer at the time of subscribing to the Newsletter.
  4. Service Recipient, in order to conclude a contract and subscribe to the Newsletter service, shall provide his or e-mail address to which he or she wants the message sent within the scope of the Newsletter service. At the moment of the subscription to the Newsletter, a contract for service provision shall be concluded and the Service Provider shall start providing said service to the Service Recipient - subject to paragraph 5.
  5. For the proper realization of the Newsletter service, the Service Recipient is obliged to provide his or her correct e-mail address.
  6. Messages sent as part of the Newsletter shall contain information about the possibility of unsubscribing from it, as well as a link allowing to unsubscribe.
  7. Service Recipient may unsubscribe from the Newsletter without giving any reason for said decision for free at any time, by opting for the option referred to in paragraph 6 or by sending a message to the Service Provider's e-mail address: biuro@desayer.pl . 
  8. Clicking the link to unsubscribe from the Newsletter or sending a message with a request to unsubscribe from the Newsletter will result in the immediate termination of the contract for the provision of said service.

 

  • 3 Complaints
  1. Complaints pertaining to the Newsletter shall be reported to the Service Provider at the following e-mail address: biuro@desayer.pl . 
  2. Service Provider shall respond to the complaint within 14 days from the moment receiving the complaint.

  • 4 Personal data

 

  1. Service Provider shall be the administrator of personal data provided by the Service Recipient in connection with the subscription to the Newsletter. Detailed information on personal data processing of the Service Provider - including its purposes, grounds, as well as data recipients, can be found in the Privacy Policy document available within the scope of the Store - it is caused by the principle of transparency included in general regulations of the European Parliament and the Council (EU ) on data protection - " GDPR ".
  2. Purpose of processing the Service Recipient's data is to send him or her the Newsletter. The basis for personal data processing in this case is a contract for the provision of a service or actions taken at the request of the Service Recipient aimed at its conclusion (Article 6 section 1 paragraph b of the GDPR), as well as the legitimate interest of the Service Provider, based on processing data in order to establish, pursue, or defend against any claims (Article 6 section 1 paragraph f of the GDPR).
  3. Providing data by the Service Recipient is voluntary, yet necessary for the provision of the Newsletter service. The failure to provide such data means that the Service Provider will not be able to provide this service.
  4. Service Recipient's data will be processed until:
    1. Service Recipient unsubscribes from the Newsletter;
    2. possibility of pursuing claims by the Service Recipient or Service Provider related to the Newsletter ceases;
    3. Service Recipient’s objection to the processing of his or her personal data is accepted - if the basis for data processing has been the legitimate interest of the Service Provider

- depending on what is applicable in a given case and what will happen last.

  1. Service Recipient has the right to request:
    1.  access to his or her personal data,
    2. amendment of such data, 
    3. deletion of such data,
    4. processing restrictions,
    5.  transferring data to another administrator
      as well as has the right to:
    6. object at any time to data processing for reasons related to the specific situation of the Service Recipient - object to the processing of personal data concerning him or her, basing on article 6 section 1 paragraph f of the GDPR (legitimate interests pursued by the administrator).
  2. In order to exercise his or her rights, the Service Recipient should contact the Service Provider.
  3. If the Service Recipient considers that his or her data is being processed unlawfully, the Service Recipient may submit a complaint to the Chairman of the Personal Data Protection Office.

 

  • 5 Final provisions
  1. Service Provider reserves the right to amend those Terms and Conditions for important reasons. Important reasons shall be the modernization of the Newsletter service or a change in the applicable law affecting the provision of the service by the Service Provider.
  2. Information about the planned change to the regulations will be sent to the Service Recipient’s e-mail address provided at the time of subscribing to the Newsletter at least 7 days before the changes are implemented.
  3. If the Service Recipient does not object to the planned changes until their entry into force, it shall be assumed that he or she accepts them.
  4. In the event of non-acceptance of the planned changes, the Service Recipient should send information about said fact to the Service Provider's e-mail address: biuro@desayer.pl. It will result in the termination of the service contract upon the planned changes entering into force. 
  5.  It shall be forbidden for the Service Recipient to provide illegal content.
  6. Contract for the provision of the Newsletter service shall be concluded in Polish.
  7. In the case of a Service Recipient who is not a Privileged Recipient, the court handling a case shall be the court having jurisdiction over the seat of the Service Provider.
